By accessing or using the Website https://getnexomind.com ("Website") or any services provided by NexoMind AI LLC ("Services"), you agree to be bound by these Terms of Service ("Terms"), along with any policies referenced herein (including the Privacy Policy). If you do not agree to these Terms, please do not access or use the Website.
NexoMind AI LLC operates an online marketplace of downloadable automation blueprints (the “Products”) sold via an authorised third-party Merchant of Record (Lemon Squeezy Inc.). Each Product is a digital file bundle (scenario JSON, setup documentation and, where applicable, recorded walkthroughs). NexoMind AI LLC also offers, on a separate and private basis, bespoke automation build engagements (“Custom Builds”) quoted individually in writing.
You must be at least 18 years of age and legally capable of entering binding contracts to use our services. By using this Website and purchasing any service, you represent that you meet these requirements. If you are acting on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
You agree to use the Website and Services in compliance with all applicable laws and regulations. You will provide accurate, current and complete information when requested and refrain from any fraudulent or illegal activities. You will not collect or attempt to collect personal data of other users without authorization. You are solely responsible for all content and instructions you provide to the Company in connection with service delivery.
Products are sold at fixed, publicly displayed prices. Checkout is processed exclusively through Lemon Squeezy Inc., acting as Merchant of Record, which issues the receipt, handles taxes, and delivers the digital files via email. All prices are in U.S. dollars. Custom Build engagements are quoted individually in writing, issued as a formal invoice, and settled before delivery commences. We reserve the right to suspend delivery or revoke access if a payment is reversed, disputed fraudulently, or otherwise invalidated.
Because Products are digital files delivered instantly upon purchase, all sales are final. A refund may be granted at our discretion, within 7 days of purchase, only when a Product is technically non-functional and cannot be made operational for the buyer’s configuration after a good-faith support exchange. Products are delivered automatically by Lemon Squeezy to the email address provided at checkout, typically within seconds. If a Product email fails to arrive, the buyer may request a redelivery at hi@getnexomind.com. Custom Build deliverables are transmitted to the contact address provided during the engagement; delivery is considered complete upon transmission. Lifetime updates to a Product are made available through the original delivery email when a new version is released.
All content, trademarks, logos, icons, software, code, designs, graphics and other materials displayed on the Website are owned by or licensed to NexoMind AI LLC and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of or publicly display any Content without our prior written consent. Upon full payment, clients receive a non-exclusive license to use delivered materials for their stated business purpose. Proprietary frameworks, tools, and methodologies remain the sole property of NexoMind AI LLC.
Both parties agree to keep confidential any non-public information disclosed during the service engagement. NexoMind AI LLC will not share your business data with third parties without consent, except as required by law or as necessary to deliver the purchased service (e.g., vetted subcontractors under confidentiality obligations).
To the fullest extent permitted by law, NexoMind AI LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Website or Services, including but not limited to loss of profits, loss of data, or business interruption. Our total liability to you for any cause shall not exceed the amount you paid for the applicable Service.
The Website and Services are provided "as is" and "as available" without warranties of any kind, express or implied. NexoMind AI LLC does not warrant that the Services will be uninterrupted, error-free, secure or fit for a particular purpose. AI-generated outputs are tools to assist your business — they do not constitute professional legal, financial, or medical advice.
You agree to indemnify, defend, and hold harmless NexoMind AI LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
You agree not to use our services or deliverables for any unlawful, deceptive, abusive, or fraudulent purpose, including but not limited to: spam, phishing, misinformation, harassment, or unauthorized data collection. NexoMind AI LLC reserves the right to refuse or terminate service for violations without refund.
